USF Holland Multi-Region Change of Operations MR-CO-05-04/2004

The following is the decision from the USF Holland Multi-Region Change of Operations MR-CO-05-04/2004, which was heard April 20, 2004, at a Special Hearing.

DECISION:  The Company’s proposed Change of Operations be approved as modified and clarified by the Company on the record with the following provisions:

1.     Based on the statements of the Company on the record and under current economic conditions, this decision shall have no adverse effect on the number of bids at any line driver domicile, nor will it result in a layoff of drivers at any domicile.

2.     As stated by the Company on the record, there shall be no use of leasors or third-part logistics companies to move traffic into or out of the Wheeling or McCook domicile within Holland’s operating area.

3.     Local unions that enjoy single line seniority shall bid in accordance with their respective bidding practices in multi-region change of operations.

4.     Health and welfare and pension contributions on behalf of those drivers who elect to relocate to a region outside their present domicile shall continue to be paid into the trust such contributions were being paid into immediately prior to the time the driver relocates.

5.     The Company’s proposed pool bidding is approved.

6.     This decision shall not serve to alter or amend the conditions of the NMFA or any of its Supplemental Agreements.

7.     Vacation schedules shall be handled in accordance with the applicable letter of understanding.

8.     Based on the fact that there will be no layoff of drivers, the request of Local 480 for a window period is denied; however, the Committee shall retain jurisdiction of this decision for a one (1) year period.  In the event there is a reduction in the number of current bids or a layoff, the Committee shall retain jurisdiction to determine if such bid reductions or layoffs are a direct result of this change of operations.

9.     Based on the fact that there are no bids from Atlanta to Wheeling or McCook, the current Local 728 bids shall not be altered as a result of this decision.

10.   The Company’s proposed bidding date of May 2nd and implementation date of May 9, 2004 is approved.  However, the Company is instructed to cooperate with drivers who are not able to report to their new location on May 9th and allow reasonable time beyond the May 9th implementation date.
